These Terms of Service ("Terms") govern your access to and use of the Too Shy platform ("Service"), operated by FLOWVATE DEVELOPMENT LTD, a company registered in Cyprus (address: 8046, Paphos, Galateias 2-4) ("Company", "we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old. We reserve the right to request age verification at any time and to terminate accounts of users who misrepresent their age.

2. Description of Service

Too Shy provides AI-generated companion characters that communicate with you via WhatsApp and Telegram. The Service includes text messages, AI-generated voice messages, and AI-generated images.

All characters are entirely fictional. They are powered by artificial intelligence and do not represent real people. AI companions do not possess genuine emotions, consciousness, or sentience. All conversations are simulated and generated by machine learning models.

3. Account Registration

To use the Service, you must provide a valid WhatsApp phone number or Telegram username to start chatting. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. Subscription Plans and Payment

The Service offers Free, Premium, and Ultra subscription tiers. Paid subscriptions are billed through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

  • Prices are listed in USD and may be subject to applicable taxes.
  • Annual plans are billed as a single upfront payment for 12 months.
  • You may cancel your subscription at any time from your account settings.
  • Cancellation takes effect at the end of the current billing period — no prorated refunds are issued.

5. Acceptable Use

You agree not to:

  • Use the Service if you are under 18 years of age.
  • Attempt to circumvent, disable, or interfere with AI safety controls or content filters ("jailbreaking").
  • Use the Service to generate, solicit, or distribute child sexual abuse material (CSAM) in any form.
  • Impersonate a real person or use the Service to create content depicting real individuals.
  • Use the Service for harassment, threats, stalking, or any illegal activity.
  • Reverse-engineer, decompile, or attempt to extract the source code or models of the Service.
  • Share, resell, or redistribute your account access or any content generated by the Service.
  • Remove or alter any AI-generated content metadata or provenance signals.
  • Use automated tools, bots, or scripts to interact with the Service.

6. AI-Generated Content

All text, voice messages, and images generated by the Service are created by artificial intelligence. No real human models, actors, or performers are involved in the creation of any content.

AI-generated content may be unpredictable. We do not guarantee the accuracy, appropriateness, or quality of any AI-generated content. You acknowledge that AI outputs may occasionally produce unexpected, incorrect, or inappropriate results.

7. 18 U.S.C. 2257 Exemption Statement

All visual content on the Service is exclusively generated by artificial intelligence. No real human models, actors, or actresses appear in any content. As such, the record-keeping requirements of 18 U.S.C. 2257 and 28 C.F.R. Part 75 do not apply to the Service.

8. Intellectual Property

The Service, including its design, code, AI models, character designs, and branding, is owned by FLOWVATE DEVELOPMENT LTD. You retain no ownership rights over AI-generated content. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for personal, non-commercial purposes only.

9. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data, including conversation content.

We do not use the content of your conversations for advertising or marketing purposes. Anonymized and aggregated data may be used to improve our AI models.

10. Medical and Professional Disclaimer

The Service is not a healthcare, medical, or mental health provider. AI companions are not licensed therapists, counselors, or medical professionals. The Service should never be used as a substitute for professional medical advice, diagnosis, or treatment.

If you are experiencing a mental health crisis or emergency, please contact your local emergency services (e.g., call 911 in the US) or a crisis helpline immediately.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL FLOWVATE DEVELOPMENT LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless FLOWVATE DEVELOPMENT LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. We are not obligated to provide refunds upon termination for cause.

14. Modifications

We may update these Terms at any time. Material changes will be communicated via the Service or email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be resolved exclusively in the courts of Paphos, Cyprus, except where mandatory consumer protection laws of your jurisdiction require otherwise.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
